Agreement to Terms

By accessing or using NEWCLANKWHODIS (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

These terms constitute a legally binding agreement between you and NEWCLANKWHODIS. We reserve the right to modify these terms at any time.

Service Description

NEWCLANKWHODIS is an AI-powered token discovery platform that analyzes and scores Clanker tokens on the Base blockchain. The Platform provides:

AI-generated quality scores for newly launched tokens
Analysis of on-chain metrics (dev buy, vault percentage, trading activity)
Creator profile information from Farcaster
Token filtering and notification systems
Beta tester leaderboard and reward distribution

Important: The Platform is a tool for information and discovery only. It does not provide financial advice, investment recommendations, or guarantees of token performance.

NEWCLANKWHODIS IS NOT A FINANCIAL ADVISOR. Nothing on this Platform constitutes financial advice, investment advice, trading advice, or any other sort of advice.

All information provided by the Platform, including AI scores, token analysis, and metrics, is for informational and educational purposes only. You should not interpret any such information as investment, financial, trading, or other advice.

You are solely responsible for determining whether any investment, strategy, or related transaction is appropriate for you based on your personal investment objectives, financial circumstances, and risk tolerance.

You should consult with licensed financial advisors, tax advisors, and/or legal professionals before making any financial decisions.

AI Limitations & Disclaimers

The AI scoring system is provided "as is" and subject to the following limitations:

No guarantees: AI scores do not guarantee token performance, legitimacy, or future value
Algorithmic analysis: Scores are generated algorithmically based on available data, which may be incomplete or inaccurate
Not comprehensive: The Platform cannot detect all risks, including rug pulls, exploits, or market manipulation
Historical data: Past performance and metrics do not predict future results
External dependencies: Scores rely on third-party APIs and blockchain data which may be delayed or incorrect

Always conduct your own research (DYOR) before investing in any cryptocurrency or token.

Your Responsibilities

Account Security

You are responsible for maintaining the security of your Farcaster account and any connected wallets. Never share your private keys, seed phrases, or passwords with anyone, including Platform administrators.

Accurate Information

You agree to provide accurate information when using the Platform, including for waitlist registration and notification settings.

Prohibited Activities

You agree NOT to:

Manipulate scores or game the system
Create fake accounts or artificially inflate share counts
Reverse engineer or exploit the Platform
Use the Platform for illegal activities
Spam, harass, or abuse other users
Scrape data or overload our systems

Compliance with Laws

You are responsible for complying with all applicable laws and regulations in your jurisdiction regarding cryptocurrency trading and taxation.

Beta Testing & $WHODIS Rewards

Beta Program Terms

The beta testing program and leaderboard competition are subject to these additional terms:

Participation is voluntary and subject to eligibility requirements
The leaderboard tracks shares of tokens via the Platform
Rankings are based on total shares, average scores, and quality metrics
Competition closes at the specified deadline (Friday 00:00 UTC)
Final standings are determined by the Platform administrators

Reward Distribution

$WHODIS tokens are distributed based on final leaderboard standings
Reward amounts are specified in the competition announcement
Distribution occurs after the competition close date
Participants must have a valid Base wallet address to receive tokens
We reserve the right to disqualify participants for rule violations
Bonus rewards for success stories are at our discretion

Important Notice

$WHODIS tokens are utility tokens for Platform access, not investment securities. Token value may fluctuate and you may lose your entire investment. Cryptocurrency regulations vary by jurisdiction - ensure you comply with local laws.

Intellectual Property

The Platform, including its design, features, code, branding (NEWCLANKWHODIS), logos, and AI models, is owned by NEWCLANKWHODIS and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or reverse engineer any part of the Platform without explicit written permission.

User Content: When you share tokens or post content through the Platform, you grant us a non-exclusive license to display and distribute that content as part of the service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEWCLANKWHODIS SHALL NOT BE LIABLE FOR:

Any trading losses, investment losses, or financial damages
Losses resulting from token rug pulls, exploits, or scams
Inaccurate AI scores, data, or analysis
Platform downtime, bugs, or technical issues
Unauthorized access to your account or wallet
Third-party actions (token creators, exchanges, other users)
Regulatory changes or legal consequences

YOU USE THE PLATFORM AT YOUR OWN RISK. The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

In no event shall our total liability to you exceed the amount you paid to use the Platform (currently $0 for beta users).

Indemnification

You agree to indemnify, defend, and hold harmless NEWCLANKWHODIS, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Platform
Your violation of these Terms
Your violation of any laws or regulations
Your investment decisions based on Platform information
Any content you submit or share through the Platform

Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause or notice, including for:

Violation of these Terms
Fraudulent or abusive behavior
Legal or regulatory requirements
Platform discontinuation

You may stop using the Platform at any time. Upon termination, your right to use the Platform immediately ceases, but these Terms remain in effect for past activities.

Changes to Terms

We may update these Terms at any time. The "Last updated" date at the top will reflect changes. Significant changes will be announced via our Farcaster channel (@newclankwhodis).

Your continued use of the Platform after changes constitute acceptance of the updated Terms. If you disagree with changes, stop using the Platform.

Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through:

Informal Resolution: Contact us via Farcaster to attempt good-faith resolution
Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration rather than court
Class Action Waiver: You agree to resolve disputes individually, not as part of any class or representative action

These Terms shall be governed by the laws of the jurisdiction in which NEWCLANKWHODIS operates, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
